extradition of the persecuted person to Romania for criminal prosecution admissible?

27. August 2018

The Higher Regional Court (OLG) of Dresden (decision of 27 August 2018 - OLGAusl 107/18) has declared the extradition of the persecuted person to Romania for criminal prosecution admissible. It refers to the decision of the European Court of Justice of 25 July 2018 - C-220/18 - on the individual clarification of the detention conditions in individual cases, if systemic deficiencies of the Romanian detention system can generally be assumed. In my opinion, the chosen scope of the examination, according to which the examination of a genuine danger of a placement of the persecuted person contrary to fundamental or human rights must be limited solely to the subsequent execution in the prison specifically designated initially after a transfer, is much too narrow.
